Chile: the smartest move for green tech patents in Latin America

The country offers 15 years of protection for industrial designs, along with robust customs enforcement against counterfeits, and legal mechanisms to safeguard brands, technologies, and market positions. In addition, this country participates in the Patent Prosecution Highway (PPH), with bilateral agreements in place with the European Patent Office (EPO), China’s CNIPA, and countries within the Pacific Alliance. As part of the Global PPH network, this initiative enables faster examination of patent applications already approved in other jurisdictions, enhancing efficiency and legal certainty for international applicants.

Tax incentives that support sustainable innovation

Chile also offers strong fiscal incentives to encourage green tech investment. Through the country’s R&D Law, companies can receive up to a 52.55 percent tax deduction on certified research and development expenses, providing significant relief for innovation-driven projects.

Moreover, certified green projects are exempt from additional taxes. Startups benefit from a three-year tax exemption along with hiring incentives. These financial advantages are designed to lower barriers to entry and accelerate the growth of sustainable ventures.

A government-driven innovation ecosystem

Chile’s commitment to sustainability and innovation is also reflected in its public policy agenda. Key milestones include the creation of the Ministry of Science, Technology, Knowledge and Innovation in 2022, the launch of a National Strategy for Green Hydrogen in 2024, and the opening of the Green Mining Research Center in Antofagasta in June 2025.

Through public funding agencies like CORFO and ANID, the Chilean government actively supports projects in clean energy, circular economy, and other strategic sectors. This alignment between public policy and private innovation creates a strong foundation for long-term impact.
