Major Development in Paraguay’s Trademark System. On June 17, 2025, Paraguay’s National Directorate of Intellectual Property (DINAPI) adopted Resolution No. 259/2025, officially approving the country’s first-ever Trademark Examination Guidelines — a milestone in the evolution of the national trademark system. These Guidelines will enter into force on August 1, 2025, and represent a key step toward greater consistency, predictability, and transparency in the registration process.
Developed with technical support from the AL-INVEST Verde program (funded by the European Union), and inspired by international best practices (including EUIPO guidelines), the document lays out clear standards for assessing:
- Absolute and relative grounds for refusal
- Distinctiveness and descriptiveness
- Examination of new types of trademarks (sound, 3D, position, multimedia, etc.)
- Issues related to bad faith, notoriety, and prior rights
For IP professionals, trademark holders, and businesses, this brings a more transparent and predictable framework — improving legal certainty and aligning DINAPI’s practices with global standards. The Guidelines are also intended as a training tool for examiners and a reference for lawyers, agents, and users navigating the registration process in Paraguay.
